Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to Uçgun AI (“Uçgun”, “we”, “Service”). By creating an account, downloading our app, or using the Service, you agree to these Terms and our Privacy Policy.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

Uçgun provides AI-assisted tools for creators and agencies: script and content generation, public profile analysis, market trends, media helpers, workspaces, credits-based billing, and related features on mobile and web.

We may change, suspend, or discontinue features with reasonable notice where practicable.

3. Eligibility

You must be at least 16 years old (or the minimum age in your jurisdiction) and able to form a binding contract. You must comply with applicable laws and platform rules (TikTok, Instagram, YouTube, etc.).

4. Accounts and security

You are responsible for your credentials and activity under your account. Notify us promptly at [email protected] of unauthorized use.

Guest and registered accounts may be subject to usage limits, credit balances, and anti-abuse controls.

5. Credits, payments, and refunds

Many features consume in-app credits (“Uçguns”). Packs are sold via cryptocurrency checkout (NOWPayments). Prices and pack sizes are shown at purchase.

Credits are generally non-refundable except where required by law or at our sole discretion for confirmed billing errors. Cryptocurrency transactions may be irreversible on-chain.

We do not provide investment, tax, or legal advice regarding crypto payments.

6. Acceptable use

You agree not to:

• Violate laws, third-party rights, or platform terms of service.
• Submit handles or content you are not authorized to analyze or use.
• Harass, defraud, spam, or distribute malware.
• Reverse engineer, scrape, or overload the Service except via documented APIs.
• Use outputs to impersonate others deceptively or generate illegal content.
• Circumvent credit, rate, or abuse limits.

7. Third-party platforms and data

When you connect social accounts or request profile analysis, you grant us permission to access data as described in the Privacy Policy. You remain responsible for compliance with each platform’s rules.

We are not affiliated with TikTok, Instagram, Google, Telegram, or other platforms mentioned.

8. AI-generated content

Outputs are generated automatically and may be wrong, biased, or outdated. You are solely responsible for reviewing, editing, and publishing content.

Monetization guides, rate cards, and similar features are informational only — not legal, tax, or financial advice.

9. Intellectual property

We own the Service, brand, and underlying technology. Subject to these Terms, you receive a limited, non-exclusive license to use the Service.

You retain rights in content you input. You grant us a license to host, process, and display it as needed to operate the Service and improve models (including aggregated/de-identified learnings where permitted).

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UÇGUN AND ITS SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/DATA.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.

13. Indemnity

You will indemnify and hold us harmless from claims arising from your content, misuse of the Service, or violation of these Terms or third-party rights.

14. Suspension and termination

We may suspend or terminate access for breach, risk, or legal requirements. You may stop using the Service at any time. Sections that by nature should survive will survive termination.

15. Governing law and disputes

These Terms are governed by the laws applicable to the operator of Uçgun AI, without regard to conflict-of-law rules.

Contact [email protected] first to resolve disputes informally. If unresolved, courts or tribunals with jurisdiction over the operator may hear the matter, unless mandatory consumer protections in your country require otherwise.

16. Changes

We may update these Terms. Continued use after the effective date constitutes acceptance. Material changes may be notified in-app or by email.
